PRIVACY POLICY

Revised 2022-04-26

1. Introduction

This privacy policy governs your use of the software application Grit ('Application') that was created by OpenLongTrails.org ('OLT', 'we', 'us', or 'our') for mobile devices. The Application is designed to aid hikers on specific trails by providing a list of waypoints, basic navigational information, and crowdsourced information about trail conditions.

You agree to this Privacy Policy, in its entirety, by accessing the Application. If you do not agree to these terms, you should not access, install, or otherwise make use of the Application.

2. What information does the Application obtain and how is it used?

2A. User Provided Information

The Application obtains the information you provide when you download and register the Application. Registration with us is mandatory in order to be able to use the Application.

The Application also provides several mechanisms for users to contribute information, such as waypoint comments, waypoint suggestions, and feedback.

When you register with us and use the Application, you generally provide (a) your email address, phone number, screen name, password, and other registration information; (b) information you provide us when you contact us for help; and (c) information you enter into our system when using the Application, such as waypoint comments.

We may also use the information you provided us to contact you from time to time to provide you with important information, required notices, and marketing promotions.

2B. Automatically Collected Information

The Application may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device's unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

GPS location information is central to the functionality of the Application, and access to the GPS radio is required for its proper functioning. Your GPS location information is not stored for later retrieval, it is only used for moment-to-moment updates of your location on the navigation screen.

If, however, you choose to enable the option to share anonymous GPS location information with OpenLongTrails.org, the Application will record the location information returned by the device and a timestamp. No personal identifiers are associated with this data, which will be sent to the OpenLongTrails.org servers when the Application is synced. Anonymous GPS location data will be used in a manner that is consistent with the OpenLongTrails.org Mission and with respect for user privacy. For example, aggregated and anonymized location information may be used to aid in keeping the trails' GPS route information up to date. Location information returned by mobile devices typically includes fields such as, but not limited to, latitude, longitude, heading, and speed.

The user can enable or disable the sharing of anonymous GPS location data with OpenLongTrails.org at any time from the Settings screen in the Application.

When you access Grit's cloud servers, such as when syncing trail data, we may log personally identifiable information, such as your IP address and the type of data accessed.

3. Does the Application collect precise real time location information of the device?

Yes. When you visit the Application, we may use GPS technology (or other similar technology) to determine your current location in order to determine your location along the trail. We do not share your location with other users or partners.

If you do not want us to use your location for the purposes set forth above, you should turn off the option to Share GPS data with OpenLongTrails from the Settings screen and/or in your mobile device settings.

4. Do third parties see and/or have access to information obtained by the Application?

Yes. We will share your information with third parties only in the ways that are described in this privacy statement.

We may disclose User Provided and Automatically Collected Information:

We may share aggregated and/or anonymized non-personal information outside of OpenLongTrails.org, for example to improve the accuracy of trail routing on third party services such as OpenStreetMap.

In circumstances not covered above, we may share your information as disclosed to you at the time of collection.

5. External Content

The Application may include links to external content on third party services. Such services may be governed by different privacy policies. OpenLongTrails.org cannot be responsible for the content on such services.

6. What are my opt-out rights?

You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes provided as part of your mobile device or via the mobile application marketplace or network.

7. Data Retention Policy, Managing Your Information

Crowdsourced information is a central feature of the Application, and some User Provided data, including but not limited to waypoint comments and waypoint suggestions, may be retained indefinitely. We will retain other User Provided data for as long as you use the Application and for a reasonable time thereafter. We will retain Automatically Collected information for up to 36 months and thereafter may store it in aggregate. If you’d like for us to delete User Provided Data that you have provided via the Application, please contact us at privacy@openlongtrails.org and we will respond in a reasonable time. Please note that some or all of the User Provided Data may be required in order for the Application to function properly.

8. Children

We do not use the Application to knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at privacy@openlongtrails.org. We will delete such information from our files within a reasonable time.

9. Security

We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

10. Changes

This Privacy Policy may be updated from time to time for any reason. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes. We will notify you of any revisions to this Privacy Policy by posting the new Privacy Policy at grit.openlongtrails.org/about/privacy-policy.html and/or by any other reasonable means of notice acceptable under applicable state and federal law. If we make a material change to the way we use personally identifiable information, we will provide notice to users via email.

11. Your Consent

By using the Application, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. 'Processing,' means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information. User information will be transferred, processed and stored under United States privacy standards.

12. Contact us

If you have any questions regarding privacy while using the Application, or have questions about our practices, please contact us via email at privacy@openlongtrails.org.
